Master Construction Stakeholder Management

This course explores the complexities of construction contract modifications, claims, and dispute resolution within the framework of widely used industry-standard agreements. Students will learn to manage contractual risks, insurance processes, termination procedures, and stakeholder responsibilities while applying best practices for effective communication and legal compliance. The course also emphasizes structured project closeout planning, ensuring a smooth transition from construction to occupancy through detailed documentation, coordination, and evaluation.

Learner Outcomes

  • Explain key concepts related to change proposals, claims, and entitlements, and evaluate how standard contract frameworks (AIA, EJCDC, DBIA, CMAA, ConsensusDocs) define and manage modifications, risks, and liabilities
  • Implement effective methods for dispute avoidance and resolution, including negotiation, mediation, arbitration, and litigation, by leveraging communication, documentation, and contractual procedures
  • Differentiate the roles and responsibilities of owners, contractors, design professionals, and third-party decision-makers in resolving contract disputes and ensuring procedural compliance
  • Identify key types of construction insurance and indemnification provisions, and demonstrate how to file and manage claims, including builder’s risk scenarios, in accordance with contract terms
  • Distinguish between suspension, stop work, and termination clauses, and prepare contractually sound notices while assessing the implications of improper execution on project outcomes and legal exposure
  • Develop and implement a comprehensive project closeout plan that includes stakeholder coordination, system commissioning, documentation, training, and post-occupancy evaluations to ensure a successful project handover
